Terms and Conditions of Attendance and Participation at Camp Airstream: Yellowstone 2025

These terms and conditions (the “Agreement”) constitute a binding agreement between the registered person (“you”) and Airstream, Inc. (“Airstream”) with respect to your participation in, involvement in and/or attendance at  “Camp Airstream: Yellowstone at Red Rock RV Park 2025, (the “Event”). This Agreement applies, but is not limited, to all persons who register for the Event, whether as an attendee, volunteer, sponsor, exhibitor, speaker and/or any other participant.

By registering for the Event you are agreeing to these terms and conditions, which form a legally binding agreement between you and Airstream. If you are registering on behalf of another it is your responsibility to ensure that the person attending/participating is aware of these terms and conditions, and accepts them, and by completing the registration, you are affirming that you have made the attendee/participant aware of these terms and conditions, and that they have accepted these terms and conditions, and you shall be liable for any noncompliance by them herewith.

1. Event admission

1.1. Access. Your completed registration provides you access to the Event. Covered in your registration cost is your RV site cost for 6-nights, including electricity, water hookup, and sewer hookup. Additional programming elements may include daily happy hours, group meals, a private Yellowstone tour, and other activities determined by Airstream. You are solely responsible for covering any and all other expenses related to your attendance or participation (including but not limited to, any accommodation and/or travel expenses) and Airstream shall have no liability for such expenses.

1.2. Refusal/Removal. You acknowledge and agree that Airstream reserves the right to refuse your registration for and/or your participation in, or request your removal from the Event if Airstream, in its sole discretion, considers your behavior and/or presence to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees, participants or speakers. If Airstream removes you from the Event for the above reasons, and you are already registered for the Event, your removal will be treated in the same way as cancellations are treated, and you will be subject to the terms of the cancellation policy in section 3.1 of the Agreement.

1.3. Image Release. Photographs and/or audio/video recordings taken at the Event by Airstream, or others on behalf of Airstream, may include your image, name, voice and/or likeness.  By attending and/or participating in the Event, you hereby grant Airstream permission to perpetually use, and to sublicense to third-parties, your photograph, image, likeness, voice and statements (whether in writing or orally) for any purpose, including, without limitation, commercial purposes, without compensation or credit to you, in any and all media, worldwide, now known or hereafter devised.

1.4. Event Content.  You acknowledge and agree that Airstream, in its sole and absolute discretion, reserves the right to change, at any time, any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue and time.

2. Cancellation policy

2.1. Cancellation Policy.  Cancellations should be made as soon as possible so that we can adjust programming accordingly.

3. Assumption of Risk / Limitation of Liability / Warranties

3.1. Voluntary Participation and Assumption of Risk. You understand and agree that participating in the event and the products and services provided in connection with the event is voluntary and may involve certain risks of physical injury, damage to property, whether physical property or intellectual property, and other damages or losses that may be sustained by you, and you assume all risk of damage, property loss, and/or personal injury which may occur as a result of participating in the event. You hereby release Airstream, its affiliates, sponsors and its official venue, and each of their respective officers, directors, shareholders, affiliates, managers, employees, volunteers, contractors, suppliers, and representatives (the “release parties”) from any and all liability associated with participating in the event including any products and services provided in connection with the event, including liability for the negligence of any released parties, unless such liability is due to the gross negligence of the released parties, in which case the release will apply to any of the released parties that were not grossly negligent.

3.2. Limitation of Liability. In no event will Airstream, its affiliates, sponsors, the venue and each of their respective officers, directors, shareholders, affiliates, managers, employees, volunteers, contractors, suppliers, and representatives be liable to you or any attendee, volunteer, sponsor, exhibitor, speaker and/or any other participator and you hereby knowingly and expressly waive all rights to seek  for any personal injury or damages to property, data loss, all indirect, incidental, special, consequential, punitive or other similar damages damages for loss of business profits or other pecuniary loss, including any direct, consequential, incidental, special, punitive or similar damages, arising out participation in the event, even if Airstream or you had been advised of the possibility of such damages.

3.3. No Warranties. Except as expressly set forth in these terms, your participation in the event, and all services and products provided in connection with the event, are provided “as is” without any warranty of any kind.  Airstream expressly disclaims all express, implied, or statutory warranties, representations or conditions, whether written or oral, including any implied warranties of merchantability, fitness for a particular purpose, security, reliability, integration, safety, or any warranties that may arise from the course of dealing. Airstream expressly disclaims any warranties not expressly stated herein and has made no representations or warranties to you about the suitability, condition or safety of the event, any equipment provided by Airstream or its vendors, Airstream’s services or products supplied as part of the event or that the event will operate without interruption or be error free.

3.4.  Without prejudice to, and without in any way limiting or restricting any of the provisions of clause 4.1, 4.2, or 4.3, and notwithstanding anything to the contrary expressed or implied, the maximum aggregate liability of Airstream for any claim in any way connected with or arising out of the Event and all products and services provided in connection with the Event or pursuant to this Agreement, whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to Airstream under this Agreement to attend the Event.

4. Privacy policy

4.1. Privacy Policy. Airstream is committed to protecting the privacy of its members, website visitors, and Event participants and attendees. Airstream operates according to a privacy policy, which is available at: https://www.airstream.com/privacy-policy/

5. Intellectual property

5.1. All intellectual property rights in and to the Event, the Event content and all materials distributed at or in connection with the Event are owned by Airstream and/or the Event sponsors, presenters, exhibitors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks (including without limitation “Camp Airstream: Yellowstone 2025) or other trade names appearing at the Event, in any Event content and/or in any materials distributed at or in connection with the Event for any reason without the prior written permission of Airstream.

5.2.  For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by Airstream or any of its affiliates or grant to you any right or license to any other intellectual property rights of Airstream or its affiliates, all of which shall at all times remain the exclusive property of Airstream and its affiliates.

6. Network

     6.1. The Event may provide attendees with access to a wired and/or wireless network. The access to this network is a privilege and not an entitlement, and must be used appropriately. Inappropriate use includes, but is not limited to: unlawful activities, interfering with the equipment or network access of others and not respecting the reasonable expectations of privacy that attendees have for traffic flowing through the network. Any deliberately malicious activities on either the wired or wireless networks will be grounds for instant dismissal from the conference (without reimbursement). If any attendees use the network inappropriately, then Airstream will take any enforcement action they consider appropriate. Enforcement action includes but is not limited to:

Suspending access to the network

Disconnecting the network permanently

The alleged offender may be asked to immediately leave the venue and/or will be prohibited from continuing to attend the Event (without reimbursement)

The incident may be reported to law enforcement

Any other measure Airstream sees fit

      6.2.  You are hereby put on notice that for security and operational reasons, Airstream may both monitor and log network traffic, and by your attendance and/or participation, you shall be deemed to have agreed hereto.

7. Audio Visual

7.1.  Audio Visual. Event organizers may provide recordings of talks (audio and/or video) given at the Event. This service is provided on a best-effort basis only. Any recordings will be released as and when they are ready, which may be some time after the conclusion of the Event, and the recordings may be of varying quality.

8. Event Rules and Regulations

8.1.  Further rules and regulations pertaining to the Event can be found below. Airstream may at any time and from time to time make further rules and regulations (having immediate effect) in relation to any aspect of the Event. Such rules and regulations shall be deemed to form part of this Agreement and shall be binding upon all persons who register for the Event, whether as an attendee, volunteer, sponsor, exhibitor, speaker and/or any other participant.

Rules are as follows. All recreational vehicles must be an Airstream product (towable or motorized, any year). You must be pre-registered for the event to enter Camp Airstream. Check-in time is from noon and to 6 PM. No late check-ins. Check out time is 11AM. We would love to have you here between these hours. If you have issues with this, please call Red Rock’s office at 208-558-7442. Red Rock RV Park does not allow late check-ins. Please plan your trip accordingly. Please take care of your valuables. Airstream is NOT responsible for any lost or stolen items. All attendees are expected to respect the rights and property of others. Loud noise and similar intrusive behavior are prohibited. No loud music. Your site has a fire ring, please do not bring your own wood, this is from the Forest Service. A complementary bundle of firewood will be provided. Red Rock RV Park welcomes your well-behaved pets if you keep them on a leash and pick up after them while in the park. There is plenty of room for them to run outside their park or in their fenced in dog park. Pets must not be left outside while guests are away from the RV Park. Red Rock has a few employees that will walk your dog for a fee while you are gone for the day, arrangements can be made at the reservation desk. No garbage is permitted to be left behind. Photographers and/or video recording may be present during your Camp Airstream: Yellowstone weekly experience. By participating and being present at Camp Airstream. You give Airstream Inc. the right to use photographs or video/audio recordings taken of you. If you do not wish to appear in photographs or be recorded, please contact your Camp Host.

9. Governing law and jurisdiction

9.1.  This Agreement shall be governed by the laws of the State of Ohio and the parties shall submit to the exclusive jurisdiction of the state or federal court located in Shelby County, Ohio, for the purpose of litigating all claims or disputes.

10. Vending, promoting and advertising

10.1.  The distribution of promotional items, flyers, handbills or printed materials is not permitted without written permission of Airstream. In addition, vending, peddling or product sampling is strictly prohibited unless you have received written permission from Airstream.

11. Indemnification.

11.1.  You agree to indemnify, defend and hold Airstream and its affiliates, and each of their respective officers, directors, shareholders, managers, employees, volunteers, contractors, suppliers, and representatives harmless from and against any and all claims, demands, and all other liabilities, including, without limitation, costs and attorneys’ fees, made by any third party arising out of or in connection with your participation in the Event or any violation of this Agreement by you.

12.  Force Majeure.

12.1.  Airstream shall not be liable to you for any delay or failure to perform hereunder due to a natural disaster, actions or decrees of governmental bodies, communicable disease, epidemic, any curtailment to or cancellation of public transport, strikes or walkouts, acts or threats of terrorism or civil unrest or any other reason which (a) hinders, delays, or prevents Airstream from performing any of our obligations, (b) is beyond Airstream’s control without Airstream’s fault or negligence, and (c) by the exercise of reasonable diligence Airstream was unable to prevent or provide against (“Force Majeure Event”). In such circumstances, Airstream will be entitled to a reasonable extension of time for performing such obligations.  If the period of delay or non-performance continues for 30 or more calendar days, Airstream may terminate this Agreement by giving you written notice and issuing you a whole or partial refund of the Event Fee.  A Force Majeure Event shall not entitle you to delay payment of any sums under this Agreement.

13. General Provisions.

13.1.  Nothing in this Agreement establishes an agency, partnership or joint venture between the parties, or relationship of employer or employee, between the parties (or between either party and the other party’s personnel). Headings are included for convenience only and will not be used to construe this Agreement. In the event that any term or provision of this Agreement is held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability will not affect any other term or provision hereof (which will remain in effect), and the parties agree thereafter to use their best efforts to substitute a provision of similar economic intent and effect. Airstream may assign this Agreement to a third-party at its discretion. Airstream may revise this Agreement from time to time, and will post the most current version on our website as soon as possible after the revised Agreement becomes effective.  For this reason, please check our website regularly.  This Agreement sets out the entire understanding of the parties in relation to their subject matter and supersedes any prior understandings or agreement between the parties whether oral or written. A delay in exercising, or failure to exercise, any right or remedy in connection with this Agreement shall not operate as a waiver of that right or remedy. No waiver in connection with this Agreement shall, in any event, be effective unless it is in writing and refers expressly to this clause. Unless expressly stated, no provision of this Agreement is enforceable by, or intended to benefit, any person who is not a party to this Agreement.
